Recurring Billing: By starting your CATHAYPLAY subscription, you authorize us to charge you one monthly, quarterly, or yearly subscription fee at the then-current rate to your Payment Method.

Price Changes: We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly provided for in these Terms, any price changes to your service will take effect following email notice to you.

Billing Cycle: The subscription fee for our service will be billed at the beginning of the paying portion of your subscription unless and until you cancel your subscription. We automatically bill your Payment method monthly, quarterly, or yearly. Subscription fees are fully earned upon payment. We reserve the right to change the timing of our billing, in particular, as indicated below if your Payment Method has not been successfully settled. Your renewal date may change due to changes in your Subscription.

No Refunds: PAYMENTS ARE NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODS. Following any cancellation, you will not be able to access any content from our website. However, you can browse our website.

Payment methods: You may edit your Payment Method information by visiting our website and clicking on “Subscription” under settings. If payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not edit your Payment Method information or cancel your account, you remain responsible for any uncollected amounts and authorize us to continue billing the Payment Method, as it may be updated. This may result in a change to your payment billing dates. For certain Payment Methods, the issuer of your Payment Method may charge you a foreign transaction fee or other charges. Check with your Payment Method service provider for details.

BY SHARING THE CATHAYPLAY SERVICE PASSWORD OR ALLOWING OTHERS TO ACCESS YOUR ACCOUNT, THE USER AGREES TO BE RESPONSIBLE FOR ASSURING THAT HOUSEHOLD SUBSCRIBERS COMPLY WITH THE TERMS & CONDITIONS AND SUCH USER SHALL BE RESPONSIBLE FOR THE ACTIONS OF THE HOUSEHOLD SUBSCRIBERS.

A User has access and control over the CATHAYPLAY account. A User’s control is exercised through the use of the User’s password and therefore to maintain exclusive control, the User should not reveal the password to anyone. In addition, if the User wishes to prohibit others from contacting CATHAYPLAY Customer Service and potentially altering the User’s control, the User should not reveal the Payment Method details (e.g., last four digits of their credit or debit card) associated with their account. You are responsible for updating and maintaining the truth and accuracy of the information you provide to us relating to your account.

You should be mindful of any communication requesting that you submit credit card or other account information. Providing your information in response to these types of communications can result in identity theft. Always access your sensitive account information by going directly to the CATHAYPLAY website and not through a hyperlink in an email or any other electronic communication, even if it looks official. CATHAYPLAY reserves the right to place any account on hold anytime with or without notification to the member in order to protect itself and its partners from what it believes to be fraudulent activity. CATHAYPLAY is not obligated to credit or discount a subscription for holds placed on the account by either a representative of CATHAYPLAY or by the automated processes of CATHAYPLAY.

All DVDs sold by CathayPlay are covered under an Educational License, intended exclusively for accredited educational institutions (including universities, colleges, high schools, and secondary schools). Under this license, the film may be used in the following ways:

a) Internal Access: The film may be made available to students, faculty, and staff for research, teaching, and other non-commercial educational purposes.

b) Private Screenings: The film may be shown in private, non-theatrical settings that are not open to the general public.

c) Classroom and On-Campus Use: The film may be screened in classrooms, lecture halls, or auditoriums within the institution.

All licensed uses must be confined to the physical premises of the purchasing institution. The license is non-transferable and does not permit distribution to third parties or external venues.

CATHAYPLAY respects the intellectual property rights of others and expects its users to do the same. CATHAYPLAY enforces third party’s intellectual property rights and can, in appropriate circumstances, suspend or terminate the accounts of members or Users who are repeat infringers. CATHAYPLAY will respond expeditiously to claims of copyright infringement committed using the CATHAYPLAY platform and/or website if such claims are reported to CATHAYPLAY’s Designated Copyright Agent identified in the sample notice below.

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the CATHAYPLAY by completing the following Notice of Alleged Infringement (“Notice”) and delivering it to CATHAYPLAY’s Designated Copyright team. Upon receipt of the Notice as described below, CATHAYPLAY will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the CATHAYPLAY.

To file a Notice of Alleged Infringement, please:

• Include both of the following statements in the body of the Notice: “I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright, or of an exclusive right under the copyright that is allegedly infringed”.
• Identify the material or link you claim is infringing (or the subject of infringing activity) and to which access is to be disabled, including at a minimum, if applicable, the URL of the link shown on the CATHAYPLAY website or the exact location where such material may be found.
• Identify the copyrighted work that you claim has been infringed, or – if multiple copyrighted works are covered by this Notice – you may provide a representative list of copyrighted works that you claim have been infringed.

When you register with CATHAYPLAY, you create your own profile. Your profile information, as well as your name, email, and photo. We may occasionally use your name and email address to send you notifications regarding new services offered by CATHAYPLAY that we think you may find valuable.

CATHAYPLAY may send you service-related announcements from time to time through the general operation of the service. Generally, you may opt out of such emails here, though CATHAYPLAY reserves the right to send you notices about your account even if you opt out of all voluntary email notifications.

CATHAYPLAY may use information in your profile without identifying you as an individual to third parties. We do this for purposes such as aggregating how many people are in a network like a band or a movie and personalizing advertisements and promotions so that we can provide you with CATHAYPLAY. We believe this benefits you. You can know more about the world around you and, where there are advertisements, they’re more likely to be interesting to you. Individuals who wish to deactivate their CATHAYPLAY account may do so on their account page. Removed information may persist in backup copies for a reasonable period of time but will not be generally available to members of CATHAYPLAY.

Where you make use of the communication features of the service to share information with other individuals on CATHAYPLAY, however, (e.g., sending a personal message to another CATHAYPLAY user) you generally cannot remove such communications.

Your use of CATHAYPLAY and any disputes arising from it is subject to this Privacy Policy and all of its dispute resolution provisions including arbitration, limitation on damages, and choice of law. We reserve the right to change our Privacy Policy at any time. Non-material changes and clarifications will take effect immediately, and material changes will take effect within 30 days of their posting on this site.
